It pays after an underlying policy is exhausted, not instead of it. If a covered auto claim runs past your auto liability limit, the umbrella picks up from there. Because of that, carriers require you to carry scheduled minimum limits underneath — commonly around $250,000 of auto liability and $300,000 of home liability before they'll write a $1,000,000 umbrella. If you later reduce an underlying limit below the schedule, that gap falls on you, not the umbrella. It's worth telling us before you change anything on the policies beneath it.
It's what the state requires to register a vehicle. Kentucky statute sets $25,000 per person, $50,000 per accident, and $25,000 property damage, or a $60,000 single limit. Nothing in that statute ties the number to what an injury actually costs — a single hospitalization with surgery and rehabilitation can pass it before anyone talks about lost wages or pain and suffering. The minimum is a floor for legality, not a plan for a bad day.
More than most people expect. Kentucky's homestead exemption — the equity in your home a creditor cannot reach — is $5,000. One motor vehicle is exempt to $2,500 and household goods to $3,000. Wages can be garnished up to 25% of disposable earnings, or the amount exceeding thirty times the federal minimum hourly wage, whichever is less. Home equity above $5,000, savings, and future income are exposed. That is the arithmetic an umbrella is built to prevent.
It's one of the clearest reasons to add one. A new driver raises both the chance of a serious at-fault accident and the size of a plausible claim, and the household's assets sit behind that policy limit. The same logic applies to a swimming pool, a dog, a boat, a trampoline, a rental property, or serving on a nonprofit board — anything that increases either the frequency or the ceiling of a liability claim.
Not for auto liability in Kentucky. The Kentucky Supreme Court has held that a household or family-member exclusion in a personal umbrella is void as applied to automobile liability coverage — meaning a Kentucky umbrella can respond when the injured person is a member of your own household. This is a genuine state-specific difference, and it is one of the reasons a national quote engine is a poor place to buy this coverage.
Umbrella forms generally provide a defense for claims they cover, and on a large liability claim the defense cost is substantial on its own. How that works — whether defense costs erode the limit or sit outside it — varies by form. We'll show you where your specific policy lands rather than give you a general answer.
An umbrella is deliberately simple. It does a small number of things and does them well above your other policies:
Excess Liability Over Auto and Home – When a covered claim runs past your underlying auto or home liability limit, the umbrella continues paying — usually in layers of $1,000,000.
Coverage Beyond Your Vehicles and House – Boats, recreational vehicles, rental property you own, and personal activities can all be brought under the same umbrella, so the protection follows the household rather than one asset.
Legal Defense – Defense of a covered liability claim — often the single largest cost in a serious case, and one that arrives whether or not the claim ultimately succeeds.
Claims Most People Never Think About – Libel, slander, and false arrest allegations are commonly covered by umbrella forms and are not the kind of thing anyone plans for.
